Paul
Higginbotham:
A Liberal's Liberal.
A Judicial Activist's Activist.
|
Judge
Paul Higginbotham is so liberal that he thinks the Wisconsin Supreme Court
is too conservative!
"I am concerned about whether the court is balanced . . . From an
ideological standpoint, the court is decidedly conservative. Many of the
decisions coming out of that court reflect a conservative agenda . .
."
--Judge Paul Higginbotham on "The Tom Clark Show," WPR, February
5, 2003
The apple doesn't fall far from the tree.
"I have a great hero who was on the Federal 3rd Circuit Court of
Appeals; and that was a cousin of mine, A. Leon Higginbotham . . . one of
the greatest jurist in the history of this country . . . I get great
inspiration from him. In talking about the U.S. Supreme Court, I'm a huge
fan of Justice William Brennen."
--Paul Higginbotham on "The Tom Clark Show," WPR, February 5,
2003
FYI: William Brennen was an ultra-liberal
justice who championed the "living Constitution" concept, i.e.
warping the Constitution to the liberal agenda of the moment. A. Leon
Higginbotham, now deceased, was a vociferous enemy of U.S. Supreme Court
Justice Clarence Thomas. Higginbotham accused Thomas of being unable to
"think black" and even tried to block Thomas from speaking at a
1998 luncheon of the black National Bar Association. During congressional
hearings into Bill Clinton's assorted wrong doings in 1998, A. Leon
Higginbotham, at that time Professor Higginbotham, told a House Judiciary
Committee that "perjury has gradations. . . . Some are serious, some
are less." He posited that Clinton's perjury was of minor
consequence; and since he was elected twice, he should not be indicted for
perjury! Those two items by themselves give a good picture of the man from
whom Paul Higginbotham draws so much inspiration!
If it is a moderate crowd, he can do that if there
are votes in it.
"There are many who paint me as politically progressive, but I am
a judicial moderate."
--Paul Higginbotham quoted in the Appleton Post-Gazette, January 17, 2003
"I am an admitted political progressive."
--Paul Higginbotham on "The Tom Clark Show," WPR, February 5,
2003
Judge Paul Higginbotham is an activist judge willing
to "limit First Amendment rights" and "chink away" at
the law . . . but at least he is "sensitive."
"And as a judge, I am very sensitive to First Amendment issues and
think that before a court can limit First Amendment rights, that a very
deliberate and thoughtful consideration needs to occur to ensure that that
is the proper thing for the court to do under the particular facts. . . .
to some extent it may be developing another niche, if you will, in the
law. And I just want to be clear about what I'm doing before I start
taking my pick and hammer and chink away here."
--Judge Paul Higginbotham, February 1, 2002, from the bench during State
of Wisconsin v. Ralph Ovadal
Birds of a feather flock together. Paul
Higginbotham's endorsements tell it all!
Dane County Circuit Judge Paul Higginbotham is one of three candidates
running for election to the Wisconsin Supreme Court. The primary election
which will take place on February 18 will eliminate one of those
candidates. Higginbotham is a typical Madison radical who has been
endorsed by a who's who of radical liberalism including: State Senators
Tim Carpenter and Gwen Moore; State Representatives Terese Berceau,
Spencer Black, Spencer Coggs, Shirley Krug, Johnnie Morris-Tatum, Mark
Pocan, Sandy Pope-Roberts, Jon Richards; Madison Mayor Sue Bauman; Dane
County Clerk Joe Parisi; Madison City Council member Mike Verveer;
Milwaukee Alderman Marvin Pratt. Among the above list are at least four
open homosexuals. All are tried and true social engineers,
pro-abortionists, and supporters of the most radical homosexual agenda
with some such as Joe Parisi openly lobbying for "gay marriage."
Judge Higginbotham's campaign chairs are just as liberal and include Lt.
Governor Barbara Lawton; Dane County Executive Kathleen Falk; and Erroll
Davis, Jr., Alliant Energy, President & CEO. Considering the
controversy which swirls around Alliant Energy and the real possibility of
future court cases involving Alliant, one must wonder why a candidate for
the state's highest court would have Erroll Davis as a campaign chairman.
A man is known by how he spends his time and the
company he keeps.
Judge Higginbotham's web site lists other endorsements as well as a list
of the positions he has held with a plethora of liberal, in some cases
even leftist, organizations including: Acting Executive Director of the
Madison Equal Opportunities Commission, 1993-1994; Dane County Minority
Affairs Coordinator, County Executive's Office, 1988-1992; Staff Attorney,
Metropolitan Milwaukee Fair Housing Council, 1986-1988; Staff Attorney,
Legal Aid Society of Milwaukee, Inc., 1985-1986; Dane County Housing
Authority, former Commissioner; Madison Mutual Housing Association, Board
of Directors, former Vice-President; NAACP, former Executive Committee
Member; Wisconsin Community Fund: Grant Allocations Board. At a recent
Wisconsin Community Fund event, Paul Higginbotham was honored by his
friend U.S. Rep. Tammy Baldwin. Other pals of Paul attending the party
included such liberal luminaries as U.S. Senator Russ Feingold and former
Madison Mayor Paul Soglin. In his acceptance speech, Higginbotham made the
standard "progressive" call for "social justice."
Higginbotham obviously is not the "middle of the road" candidate
he would have voters believe him to be. His interests and experience have
clearly been of the leftist, socialist persuasion.
The man who would be a supreme court judge is proud
of having been the head WORT!
On his official website, Paul Higginbotham includes in his resume for the
open supreme court position that he is the former president of the WORT
Radio board of directors. WORT Radio is a hard-core pro-homosexual,
pro-abortion, socialist station which broadcasts from the belly of the
beast, 118 South Bedford Street in Madison. WORT's trademark is foolish,
at times filthy, language, and a decidedly leftist flavor.
The most helpless of Wisconsin citizens will get no
justice or mercy from Paul Higginbotham.
When it comes to abortion, Paul Higginbotham is perhaps the most openly
enthusiastic supporter of preborn child killing to ever seek election to
the bench. Candidates for the judiciary almost always defer to outright
state their positions on abortion, the more so the higher the position
sought, due to possible conflict of interest problems. At the very most,
the candidate will murmur his "personal" position and then
quickly add that it will not have a bearing on how he rules on abortion
cases. Not so Paul Higginbotham. At a recent candidate forum in Madison
sponsored by the Dane County Bar Association, Higginbotham jumped at the
chance to burnish his credentials with the pro-death crowd. According to a
Wisconsin State Journal report on the event (1-28-03), Higginbotham
volunteered his conviction that Wisconsin "absolutely" needs a
constitutional amendment protecting "abortion rights." He also
stated, "It's about a woman's power over herself and a woman's
ability to control her own life."
A Capital Times (1-29-03) report of the same event contains this:
"'I support Roe v. Wade,' said Higginbotham. 'I think it was properly
decided, and I believe that it is important for us to continue to support
a woman's right to choose. And I don't accept any dancing around on that
issue. It is important that a woman have a right to choose because it is
about power.' Higginbotham called partial birth abortion an 'awful, awful
procedure,' but said it should be available if a woman's life is at
risk."
